1. Introduction & Acceptance
Welcome to Online Austin. These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "Student") and Austin Education Foundation Pvt. Ltd. ("Company," "we," "us").
By accessing our website, mobile application, or purchasing any IELTS/PTE course packages, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you are strictly prohibited from using the Site and our Services.
2. Eligibility & Account Registration
You must be at least 16 years of age to create an account on Online Austin. If you are under 16, you may use the Services only with the involvement and consent of a parent or guardian.
Account Security:
- You agree to provide accurate, current, and complete information during the registration process.
- You are responsible for safeguarding your password. You agree not to disclose your password to any third party.
- You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
The Company reserves the right to suspend or terminate your account if any information provided happens to be inaccurate, false, or misleading.
3. Course License & Access Rights
When you purchase a course on Online Austin, you are granted a limited, non-exclusive, non-transferable, revocable license to access and view the course content for your personal, non-commercial, educational use.
Restrictions on Use
You are not purchasing the content itself, but a license to view it. This license does not give you any right to resell the course in any manner (including by sharing account information with a purchaser or illegally downloading the course and sharing it on torrent sites).
- Validity Period: Course access is valid only for the duration specified in your package (e.g., 30 days, 6 months). Access will automatically be revoked upon expiry unless renewed.
- Concurrent Sessions: Our system limits the number of concurrent sessions. You cannot be logged in from multiple devices simultaneously.
4. Payments & Fees
All prices listed on the platform are in Nepalese Rupees (NPR) and are inclusive of applicable taxes (VAT) unless stated otherwise.
- We reserve the right to change pricing or run promotional offers at any time without notice.
- Payments must be completed through the approved methods listed on our website (eSewa, Khalti, Bank Transfer).
- Access to paid courses will only be activated after full payment confirmation by our finance team.
5. Intellectual Property Rights
The Service and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of Austin Education Foundation Pvt. Ltd. and its licensors.
Strict Prohibition on Piracy:
You strictly agree NOT to download, record (screen-record), copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any content for any other purposes without the prior written consent of the Company. Violation of these rights will result in immediate legal action under the Copyright Act, 2059 (2002) of Nepal.
6. Prohibited User Conduct
You agree not to use the Service to:
- Upload, post, email, or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or hateful.
- Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity.
- Upload or transmit viruses, Trojan horses, or any other malicious code.
- Engage in any automated use of the system, such as using scripts to send comments or messages.
7. Disclaimers & Limitation of Liability
No Guarantee of Results: While our courses are designed to help you succeed, Online Austin does not guarantee specific band scores or admission to any university. Your results depend on your own effort, background, and preparation.
"As Is" Basis: The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Company makes no representations or warranties of any kind, express or implied, regarding the operation of their services, or the information, content, materials, or products included on this website.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Kathmandu District Court.
